By accessing our website, purchasing our services, or using any of our digital solutions, you ("Client," "Customer," or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
3. Service Descriptions
3.1 Hosting Only Package
Our basic hosting service includes:
- Website hosting supporting static HTML/CSS/JavaScript sites, WordPress installations, and Docker container deployments
- SSL certificate installation and maintenance
- Daily automated backups with 30-day retention
- 24/7 server monitoring and uptime management
- Email technical support
- 99% uptime guarantee
3.2 Professional Package
Our comprehensive digital solution includes:
- Professional website design and development
- Mobile-responsive layout optimization
- Content management system implementation
- Monthly website updates and maintenance
- Monthly SEO optimization and performance reports
- Google Business profile setup and ongoing management
- Local SEO optimization for Arizona market
- Direct access to founder's contact information
- 24-hour response guarantee for all requests
3.3 Custom Development Services
Project-based development services including:
- Custom web applications
- iOS and Android native mobile applications
- Business process automation and AI solutions
- Third-party system integration and API development
- Enterprise software solutions
4. Billing and Payment Terms
4.1 Subscription Services
- Hosting Only and Professional Package services are billed monthly in advance
- Payment is processed automatically via Stripe on your billing date
- All prices are in USD and exclude applicable taxes
- Price changes require 30 days advance notice
4.2 Custom Development
- Custom projects are billed based on agreed milestones
- 50% deposit required to begin work
- Remaining balance due upon project completion or milestone achievement
- Additional work outside original scope billed separately
4.3 Late Payments
- Services may be suspended for accounts 7 days past due
- A $25 late fee applies to overdue accounts
- Service restoration requires payment of all outstanding balances plus late fees
5. Service Level Agreements
5.1 Uptime Guarantee
- We guarantee 99% uptime for all hosting services
- Downtime credits automatically applied for outages exceeding this threshold
- Planned maintenance excluded from uptime calculations
5.2 Response Time Guarantee
- Professional Package clients receive guaranteed response within 24 hours
- Hosting Only clients receive response within 48 hours during business days
- Emergency support available for critical issues
6. Intellectual Property Rights
6.1 Ligma Digital LLC Ownership
- All code, development frameworks, proprietary methods, and technical solutions remain the exclusive property of Ligma Digital LLC
- Clients receive a non-exclusive license to use delivered websites and applications
- Source code and development methodologies are not transferred to clients
6.2 Client Content Ownership
- Clients retain full ownership of their content, data, images, and business information
- Clients grant Ligma Digital LLC license to use content solely for service delivery
- Client logos and branding may be used in our portfolio with permission
7. Content Standards and Prohibited Uses
7.1 Prohibited Content
Clients may not use our services for websites or applications containing:
- NSFW content including adult or sexually explicit material
- Illegal content violating federal, state, or local laws
- Hateful content promoting discrimination based on race, religion, gender, sexual orientation, or other protected characteristics
- Content promoting violence, self-harm, or illegal activities
- Illegal goods, regulated substances, or prohibited services
- Copyrighted material without proper authorization
7.2 Content Review and Enforcement
- Ligma Digital LLC reserves the right to review client content at any time
- Violations result in immediate service termination with full refund
- Clients have 24 hours to correct minor violations before termination
- Severe violations result in immediate termination without notice
7.3 Client Responsibilities
- Clients are solely responsible for all content published through our services
- Clients must ensure compliance with all applicable laws and regulations
- Clients must provide accurate information and maintain current contact details
8. Cancellation and Termination
8.1 Client Cancellation
- Subscription services may be cancelled at any time with 30 days written notice
- Cancellation takes effect at the end of the current billing period
- No refunds for partial months except as specified in our Refund Policy
8.2 Termination by Ligma Digital LLC
- We may terminate services immediately for content policy violations
- We may terminate services with 30 days notice for non-payment
- We may terminate services immediately for breach of these Terms
8.3 Effect of Termination
- Client access to services ceases immediately upon termination
- Client data will be available for download for 30 days after termination
- All outstanding balances become immediately due upon termination
9. Limitation of Liability
9.1 Service Limitations
- Services provided "as is" without warranties beyond those explicitly stated
- We are not liable for indirect, incidental, or consequential damages
- Total liability limited to amounts paid by client in the 12 months preceding the claim
9.2 Force Majeure
- We are not liable for service interruptions due to circumstances beyond our control
- This includes natural disasters, government actions, internet outages, or third-party service failures
10. Dispute Resolution
10.1 Governing Law
- These Terms are governed by Arizona state law
- Any disputes subject to jurisdiction of Arizona courts
10.2 Resolution Process
- Good faith negotiation required before formal legal action
- Mediation preferred for dispute resolution
- Client may file complaints with Arizona Attorney General if resolution cannot be reached
